RELEASE OF LIABILITY

The person who is named below is referred to as “Guest.” I am either the Guest or, if the Guest is under 18, I am the Guest’s parent or legal guardian. As a guest of the Smith/Dupuy families, I will be using their home and related amenities (including any facilities, equipment and vehicles) at 1111 Staples Rd. San Marcos, TX 78666 (the "Facilities"). In consideration of such use, I do hereby release and forever discharge Two Rivers Interests LP and all members of the Smith/Dupuy family, and their respective agents, servants, employees, heirs, personal representatives, affiliates, successors and assigns (the "Owner Parties"), from any and all claims, costs, actions, damages, personal injuries, death and liabilities, including attorney's fees, of any kind and nature imposed upon, incurred by or asserted against any of the Owner Parties, which arise out of or in any way relate to the use and occupancy of the Facilities, WHETHER CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OR FAULT OF ANY OF THE OWNER PARTIES.

This Release contains the entire agreement between the parties and shall be binding upon the undersigned, and his/her respective heirs, executives, administrators, personal representatives, successors and assigns. This Release shall be subject to laws of the state of Texas.

I have read, understand and agree to the terms of this Release. I have signed this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to me. My signature is evidence of my intention to execute a complete and unconditional release of liability to the full extent of the law. I am 18 years of age or older and mentally competent to enter into this Release.

If I am accompanied by any minor children, then this Release of Liability is also being executed in my capacity as parent of the following minor children that are in my care and custody at the Facility.
